Terms and Conditions

Thank you for your interest in participating in the Buller Gorge Marathon. Before you register, we recommend you review and acknowledge the following terms and conditions:

Words including ‘holder’, ‘bearer’, ‘participant’, and ‘purchaser’ refer to you: the person who registers in the Buller Gorge Marathon. ‘Our’, ‘us’, ‘we’, ‘issuer’, ‘provider’ will refer to The Buller Gorge Marathon Trust, the organisers of The Buller Gorge Marathon.

By opting to purchase, allocate or possess tickets to the Buller Gorge Marathon you automatically agree to our terms and conditions of use.

The Buller Gorge Marathon Trust reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions – without any prior notifications to you. Such changes will be duly reflected on the event website: www.bullergorgemarathon.co.nz. These changes will relate back to your original date of registration in the Buller Gorge Marathon.

The event service will be deemed to have been delivered in its entirety as soon as the Buller Gorge Marathon commences. From that point on, no refund requests will be accepted.

If the Buller Gorge Marathon is cancelled in its entirety due to any unforeseen circumstances, the Buller Gorge Marathon Trust has the sole and absolute right to:
1/ reschedule the event, or
2/ issue a partial refund, or
3/ issue a full refund.

Please note that the decision of the issuer in such instance will be deemed final and binding.

EVENT CANCELLATION POLICY
There will be no refunds in the case of course alterations or a complete cancellation due to safety reasons, or weather circumstances outside of the Race Directors control.

If the Buller Gorge Marathon is cancelled due to any factors or causes not in the control of the issuer, the latter will offer a partial or full refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, Government announcements, pandemics, strikes, delays in production, and the like. Once again, the decision of the Buller Gorge Marathon Trust will be considered final.

In case the event is fully cancelled, the refund, if issued, will include ONLY the face value/printed value of the registration. The bearer cannot, under any circumstances, claim refunds on any fees, any costs incurred, or any other such charges.

If the Buller Gorge Marathon needs to be rescheduled to some other date, participants will not be eligible for any refund. An alternate race day will be chosen by the Buller Gorge Marathon Trust and existing registrations will automatically transfer to the new event date.

By registering in the Buller Gorge Marathon and presenting at the venue, you give your consent to the Buller Gorge Marathon Trust to collect the following information about yourself (name, picture, date of birth, gender, address, including email address) for verification purposes and for the purpose of communicating information about the event only. The Buller Gorge Marathon Trust store such information in a secure manner.

We also reserve the right to use images for promotional purposes.

The Buller Gorge Marathon Trust does not take any responsibility for any personal injury or financial damage caused to you at the venue, or for any items lost, stolen, or misplaced at the venue. Financial reimbursement claims on these counts will not be considered.

We reserve the right to withdraw any competitor who the Race Referee, Race Director or Chief Medical Officer consider to be under severe physical or mental stress.

We also reserve the right to disqualify any competitor who does not follow the race rules or who is deemed to be a risk to themselves or others at any point during the event.

The Buller Gorge Marathon and The Buller Gorge Marathon Trust follow a common ‘zero-tolerance policy’ regarding unauthorised drug use, or possession at the venue, AND regarding any behaviour, or actions that may be interpreted as lewd or obscene. If you are found in possession of prohibited items, or if you indulge in any objectionable action, your participation in the event will be terminated immediately.

Any merchandise purchased at the time of the original registration and then fulfilled by our merchandise provider cannot be refunded.

At no stage are any entries transferable to any other year’s Marathon event.

If you are unable to compete, you understand that your registration fee is non-refundable.
